2. Scope of This Policy

This Privacy Policy describes how we collect, use, disclose, and protect personal information when you:

  • Visit fitnessradio.com and its subdomains (including radio.fitnessradio.com)
  • Create or use a Fitness Radio account
  • Use the Fitness Radio mobile application for Android or iOS
  • Purchase or manage a subscription, including corporate and multi-seat plans
  • Contact us for customer support

Collectively, these are the "Services." This policy does not apply to third-party websites, applications, or services that we do not control, even where they are linked from our Services.

3. Information We Collect

3.1 Information You Provide to Us

CategoryExamples
Account informationName, email address, password (stored only as a salted cryptographic hash), display name
Subscription and billingPlan selected, billing cycle, subscription status, transaction history, partial payment card details (last four digits, card brand, expiration)
Corporate account dataOrganization name, seat allocations, sub-user invitations, administrator contact details
User contentPlaylists you create, favorites, ratings, station preferences, and playback settings
Support communicationsMessages, email correspondence, and any information you voluntarily include when contacting us

We do not collect or store full payment card numbers. Payments are processed by our third-party payment processor, Stripe, and by Google Play Billing or Apple In-App Purchase where you subscribe within our mobile applications. Those providers handle your card and payment credentials under their own privacy policies.

Sign in with Google and Sign in with Apple

You may create an account or sign in using a third-party identity provider. When you do, we receive from that provider a unique identifier for your account, your email address, and, where you permit it, your name. Apple offers the option to hide your email address, in which case we receive a private relay address instead of your personal one; we treat that address the same as any other account email.

We use this information only to create and authenticate your account and to link it to any existing account with the same email address. We do not receive your password, and we do not post to or read from your Google or Apple account. Signing in this way is governed on their side by Google's and Apple's own privacy policies.

You can disconnect a linked provider at any time in Account Settings, or revoke access from your Google or Apple account. Disconnecting does not delete your Fitness Radio account; see Section 12.2 for deletion.

3.2 Information Collected Automatically

  • Device and application information: device model, operating system and version, application version, language and locale settings, and a randomly generated device or installation identifier.
  • Log and connection data: IP address, approximate location derived from IP address (city or region level), access timestamps, referring URLs, and browser type and version.
  • Playback and usage telemetry: tracks and stations played, playback duration, skips, buffering and streaming quality events, session length, and feature usage.
  • Diagnostics: crash reports, error logs, and performance data used to diagnose and repair defects.

3.3 Information From Other Sources

  • Identity providers (Google and Apple) provide the account information described in Section 3.1 when you sign in using their services.
  • Payment processors and app stores provide us with transaction confirmations, subscription status, renewal and cancellation events, and refund status.
  • Corporate account administrators may provide your name and email address in order to invite you to a seat on their organization's subscription.

3.4 Fraud and Trial-Abuse Prevention Identifier

Free trials are limited to one per person, payment method, and organization. To enforce this limit, we create and retain a pseudonymized identifier when an account is deleted.

How it works. We take your email address and, where available, an identifier for your payment method supplied by our payment processor, and transform them using a one-way cryptographic function with a secret key held only on our servers. The result is a fixed-length value that cannot be read, reversed, or used to contact you, and that does not constitute an account. When a new account is created, we generate the same value from the new registration details and compare it against our stored list. If it matches, the new account may subscribe at standard pricing but is not eligible for a free trial.

What we do not keep. The original email address and payment details are erased with the rest of your account. We retain only the transformed value.

Retention. We retain this identifier for 24 months from the date of deletion, after which it is automatically purged.

Scope. This mechanism applies to accounts created and subscriptions purchased on our website. Where you subscribe through Google Play or the Apple App Store, trial eligibility is determined by that store's own systems and rules, which operate independently of ours.

4. Cookies and Similar Technologies

We use cookies, local storage, and similar technologies to keep you signed in, remember your preferences, maintain session security, and understand how the Services are used.

We use the following categories:

  • Strictly necessary — authentication, session management, security, and load balancing. These cannot be disabled through our Services.
  • Functional — remembering volume, playback quality, and interface preferences.
  • Analytics — aggregate measurement of feature usage and performance.

Most browsers allow you to refuse or delete cookies through their settings. Disabling strictly necessary cookies will prevent you from signing in or streaming.

5. How We Use Your Information

We use personal information to:

  • Create, authenticate, and maintain your account
  • Deliver audio streams and the features you request
  • Process subscriptions, payments, renewals, cancellations, and refunds
  • Provision and manage corporate multi-seat accounts and sub-user invitations
  • Personalize station and playlist recommendations and remember your preferences
  • Provide customer support and respond to your inquiries
  • Monitor, secure, and improve service reliability and audio streaming performance
  • Detect, investigate, and prevent fraud, abuse, unauthorized access, and violations of our Terms of Service, including enforcing our one-trial-per-person limit as described in Section 3.4
  • Send transactional communications, including receipts, renewal notices, security alerts, and service announcements
  • Send marketing communications where you have opted in or where otherwise permitted by law, subject to your right to opt out at any time
  • Report aggregated or de-identified playback counts to music rights holders, licensors, and performing rights organizations as required by our licensing agreements
  • Comply with legal obligations and enforce our agreements

We do not use your personal information to make decisions producing legal or similarly significant effects about you through solely automated means. The trial-eligibility check described in Section 3.4 determines only whether an account qualifies for a promotional free trial; it does not deny you access to the Services, which remain available at standard pricing.

6. Legal Bases for Processing (EEA, UK, and Switzerland)

Where the GDPR or UK GDPR applies, we process personal information on the following legal bases:

  • Performance of a contract — creating your account, delivering streams, and processing subscription payments.
  • Legitimate interests — securing the Services, preventing fraud and abuse (including the trial-abuse prevention described in Section 3.4), improving reliability and performance, and providing customer support, balanced against your rights and freedoms.
  • Consent — optional analytics and marketing communications, where required; you may withdraw consent at any time.
  • Legal obligation — tax, accounting, licensing reporting, and responding to lawful requests.

7. How We Share Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

We disclose personal information only as follows:

  • Service providers. We use vendors who process data on our behalf under written contracts limiting their use of the data to the services they provide to us. These include cloud hosting and content delivery, payment processing, transactional email delivery, analytics and crash reporting, and customer support tooling.
  • Corporate account administrators. If you use a seat on an organization's subscription, that organization's administrator can see your name, email address, seat status, and whether the seat is active. Administrators may deactivate your seat, and may terminate all seats by deleting the organization's account. Administrators do not receive your password.
  • App stores. Google Play and the Apple App Store receive purchase and subscription data when you transact through them, and control the billing relationship for those purchases.
  • Rights holders and licensors. We report aggregated or de-identified playback statistics as required by our music licensing agreements. These reports do not identify you individually.
  • Legal and safety. We may disclose information where we believe in good faith that disclosure is required by law, subpoena, court order, or other legal process, or is necessary to protect the rights, property, or safety of Fitness Radio, our users, or the public.
  • Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets, personal information may be transferred as part of that transaction. We will notify you of any such transfer and of any material change to this policy.

8. Data Retention

We retain personal information for as long as your account remains active and for the period afterward described below:

DataRetention Period
Account and profile informationUntil account deletion, then erased within 30 days
Favorites, preferences, playback historyUntil account deletion, then erased within 30 days
Playlists and compilationsRetained after deletion in de-identified form (see Section 12.3)
Fraud and trial-abuse identifier (Section 3.4)24 months from account deletion, then automatically purged
Transaction and billing records7 years, as required for tax and accounting purposes
Server and access logs90 days
Playback telemetry (identifiable)12 months, then aggregated or de-identified
Support correspondence24 months after resolution
Routine system backupsOverwritten on our standard rotation; not restored to active systems except for disaster recovery

We may retain information longer where required by law, or where necessary to resolve disputes, prevent fraud and abuse, or enforce our agreements.

9. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption of data in transit using TLS, encryption of stored data at rest, hashed password storage, access controls limiting employee and contractor access to what is needed to perform their role, and regular monitoring of our infrastructure.

The secret key used to generate the identifier described in Section 3.4 is stored separately from the identifiers themselves and is accessible only to systems that require it.

No method of transmission or storage is completely secure. We cannot guarantee absolute security, and you are responsible for keeping your account credentials confidential. If you believe your account has been compromised, contact us immediately at privacy [at] fitnessradio.com.

10. International Data Transfers

We are based in the United States, and our infrastructure and service providers are located in the United States. If you access the Services from outside the United States, your personal information will be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country.

Where we transfer personal information from the EEA, the United Kingdom, or Switzerland, we rely on the European Commission's Standard Contractual Clauses, the UK International Data Transfer Addendum, or another lawful transfer mechanism. You may request a copy of the relevant safeguards by contacting us.

11. Children's Privacy

The Services are intended for adults. Our Terms of Service require account holders to be at least 18 years old. The Services are not directed to children, and we do not knowingly collect personal information from anyone under 18.

If we learn that we have collected personal information from a person under 18, we will delete it promptly. If you believe a minor has provided us with personal information, contact us at privacy [at] fitnessradio.com.

12. Your Rights and Choices

12.1 Account Access and Correction

You may review and update your account information at any time by signing in and visiting your account settings.

12.2 Account Deletion

You may permanently delete your account and associated personal information at any time:

  • In the mobile app: Settings → Account → Delete Account
  • On the web: fitnessradio.com/delete-account
  • By email: send a request to privacy [at] fitnessradio.com from the email address on your account

Deletion is immediate and permanent. Your access to the Services ends as soon as you confirm, regardless of how much prepaid subscription time remains, and we cannot restore a deleted account. Before we proceed, we will tell you how much prepaid time you will forfeit and offer cancellation as an alternative — cancelling stops future billing while preserving your access through the end of the period you have paid for.

We permanently erase your account, profile, credentials, contact information, favorites, playback history, device records, and support correspondence within 30 days of your request. Section 12.3 describes the limited categories we retain.

If you subscribed through Google Play or the Apple App Store, deleting your Fitness Radio account does not cancel that subscription. The store controls that billing relationship and will continue to charge you until you cancel through the store directly. We cannot cancel or refund it on your behalf.

Corporate and gym accounts. Deleting an administrator account terminates the organization's entire subscription and every seat under it. All sub-users lose access at the same time, and organizational records including client rosters and seat assignments are deleted with the account. If you are the sole administrator, you are responsible for notifying your sub-users before you delete.

12.3 What We Retain After Deletion

Deletion removes your personal information, with these limited exceptions:

  • The fraud and trial-abuse identifier described in Section 3.4, retained for 24 months. This is a pseudonymized value that cannot be read or reversed and cannot be used to identify or contact you.
  • Transaction, billing, and tax records, retained for the period required by applicable law.
  • Playlists and other compilations you created. Under Section 10 of our Terms of Service, these belong to Fitness Radio and may remain on the Service. Before we retain one, we remove your name, username, profile image, and any other information identifying you, and it is no longer attributed to you. You may ask us to remove a specific compilation rather than retain it by contacting privacy [at] fitnessradio.com; we will consider such requests and will honor them where applicable law requires.
  • Records reasonably necessary to establish, exercise, or defend legal claims, comply with a legal obligation, or enforce our agreements.
  • Residual copies in routine backups, overwritten on our standard rotation and not restored to active systems except for disaster recovery.

12.4 Marketing Communications

You may opt out of marketing email at any time using the unsubscribe link in any marketing message or by contacting us. You cannot opt out of transactional messages such as receipts, renewal notices, and security alerts while your account remains active.

12.5 Push Notifications and Device Permissions

You may disable push notifications and revoke app permissions through your device settings at any time.

12.6 Global Privacy Control

We honor the Global Privacy Control (GPC) signal where transmitted by your browser.
